It has been estimated that 50,000 lawsuits are filed in this country every day of the week. This "litigation explosion" has many causes...a breakdown of traditional values, too many hungry lawyers, wasteful insurance companies, the self absorbed "victim" syndrome and the absence of responsibility. Litigation is time consuming, expensive and emotionally debilitating. If you are engaged in any business activity or if you have tenants in a rental property or have a professional practice it is likely that you will be sued sooner or later.
Our legal system should hold people accountable for their actions, such as when someone causes injury. Most of you would probably agree that it would be a fair principle to require a person who injures another to fairly compensate the victim for his/her loss. The problem is that this basic principle bears little or no relationship to what is occuring in the legal system today. The reality of our present legal system is that people are named as defendants in lawsuits not so much because of their degree of fault, but rather because of their ability to pay. Such defendents have become known as "deep pockets" simply because they have amassed wealth.
The math is disturbing:There are nearly 1 million lawyers in the U.S. and another 100,000 graduate law school each year and set up practice. There are roughly 100 million adults in the U.S. and approximately 30 million have assets of sufficient value to deem them as being a potential "deep pocket". This makes for bad odds. The reality is that you need to remove the incentive to sue you.
The primary objective of a sound plan is to protect your personal and business assets from potential lawsuits and claims. You need to plan in such a way as to make your assets unreachable and unavailable. Since a lawyer for a potential plaintiff will ordinarily only sue you if he/she knows there are accessible assets and that he/she will be paid, it is unlikely that they would be willing to file a "contingency fee" case (wherein they typically receive 30-40% of the settlement) against you.
